Introduction

These Terms of Service (“Terms”) govern your access to and use of blerbz.com (the “Website”) and the Blerbz App (the “App”), collectively referred to as the “Services.” The Services are operated by Blerbz (“we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not use the Services.

1. Eligibility

You must be at least 13 years of age to use the Services. By using the Services, you represent that you meet this minimum age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Services

Blerbz is an AI-enriched news intelligence platform that aggregates and ranks news content from publicly available sources. The Services include (non-exhaustive):

• News aggregation — Curated feeds from RSS, APIs, and selected social sources.
• Product surfaces — Including the main feed/window experience, BLERBZ100, Focuz, local and topic views, Paper, Cover, and related pages as we offer them from time to time.
• BLERBZ100 rankings — Algorithmic daily rankings of top stories using engagement, velocity, freshness, source reputation, and related factors.
• AI-enhanced content — Summaries, topic tags (“blerbles”), and enrichment via artificial intelligence (including third-party models such as Grok where applicable).
• STREAM & Labs — AI-assisted video and BLERBZ Labs / Mission Control tooling for production workflows.
• NUCLEUZ API — Developer access to documents, feeds, and related endpoints (including v2 REST APIs with authentication and rate limits).
• Premium features — Optional paid features, StoreKit/Google Play purchases, web checkout purchases, credits, and subscriptions where offered.

3. User Accounts & Premium Features

The core Services do not require account creation or login. Certain premium features may require you to provide an email address, use Sign in with Apple, or complete a platform purchase so we can provide credits, subscriptions, restore purchases, and account deletion.

• You are responsible for maintaining the confidentiality of any account credentials.
• You agree to provide accurate and complete information when purchasing premium features.
• You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any manner that could disable, overburden, damage, or impair the Services or interfere with any other party's use of the Services.
• Use any automated system, including bots, scrapers, or crawlers, to access the website or undocumented endpoints in a manner that exceeds reasonable use or circumvents rate limits, without our prior written consent. Approved developer access must use the NUCLEUZ API with valid credentials and documented limits.
• Attempt to gain unauthorized access to any portion of the Services, other accounts, or any systems or networks connected to the Services.
• Use the Services to transmit any malicious code, viruses, or other harmful material.
• Reproduce, distribute, modify, or create derivative works of the Services or any content provided through the Services, except as expressly permitted.
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices on the Services.

5. Intellectual Property

Our Content

The Services, including the design, layout, algorithms, software, rankings, AI-generated summaries, and all other original content created by Blerbz, are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our original content without our prior written permission.

Third-Party Content

The Services aggregate and display news content from third-party sources. This content remains the property of the respective publishers and is subject to their terms and conditions. Blerbz does not claim ownership of third-party content. Links to original articles direct you to the original publisher's website.

Trademarks

“Blerbz,” “BLERBZ100,” “Blerbles,” “NUCLEUZ,” “STREAM,” and related logos are trademarks of Blerbz. You may not use these marks without our prior written consent.

6. Payments & Subscriptions

Certain premium features require payment. By purchasing a subscription or premium feature:

• You agree to pay all fees associated with your selected plan.
• Payments are processed securely by Apple, Google, or Stripe, depending on where you purchase. We do not store your credit card information on our servers.
• App subscriptions purchased through Apple or Google automatically renew unless you cancel through the applicable app store subscription settings before renewal.
• Web subscriptions or purchases processed by Stripe are managed through the BLERBZ web checkout or support flow.
• Consumable credits do not expire after purchase, but deleted accounts may lose unused account-linked credits as disclosed in the in-app deletion warning.
• Refunds for App Store or Google Play purchases are handled by Apple or Google under their policies. Other refunds are handled on a case-by-case basis at our discretion.

7. AI-Generated Content

The Services use artificial intelligence to generate summaries, topic tags, video content, and other enrichments. You acknowledge that:

• AI-generated content is provided for informational purposes and may contain inaccuracies.
• AI-generated content does not constitute professional advice of any kind (financial, legal, medical, or otherwise).
• You should verify important information by consulting the original source articles linked within the Services.
• We continually work to improve the accuracy and quality of AI-generated content but do not guarantee its completeness or correctness.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Services will be uninterrupted, timely, secure, or error-free.
• The content displayed through the Services is accurate, complete, reliable, or current.
• Any errors or defects in the Services will be corrected.

Blerbz aggregates content from third-party sources and does not endorse, verify, or assume responsibility for the accuracy or reliability of any third-party content displayed through the Services.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Blerbz and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Services, regardless of the theory of liability.

In no event shall our total liability to you for all claims arising out of or related to the Services exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty dollars ($50), whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Blerbz and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your violation of these Terms or your use of the Services.

11. Third-Party Links & Services

The Services may contain links to third-party websites, applications, or services that are not owned or controlled by Blerbz. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. You access third-party content at your own risk.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if continued access would be harmful to the Services or other users.

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive.

13. Modifications to the Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

14. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the effective date at the top of this page (and may note substantive updates in our support hub). Your continued use of the Services after the revised Terms are posted constitutes your acceptance of the changes. We encourage you to review these Terms periodically.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in accordance with applicable law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blerbz regarding the use of the Services and supersede any prior agreements or understandings.
